Our Property: FleekSeek, including its design, features, AI technology, and content, is owned by us and protected by intellectual property laws.
Your Content: You retain ownership of photos you upload. By uploading photos, you grant us a limited license to process them for providing our services.
Analysis Results: The color analysis results and recommendations we provide are for your personal, non-commercial use only.

In no event shall our total liability exceed the amount you paid us in the twelve (12) months preceding the claim, or fifty dollars ($50), whichever is greater.
You agree to indemnify, defend, and hold harmless FleekSeek, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from:

Informal Resolution First: Before filing any claim, you agree to try to resolve the dispute informally by contacting us at support@fleekseekapp.com. We will try to resolve the dispute within 60 days.
Binding Arbitration: If we cannot resolve the dispute informally, any dispute, claim, or controversy arising out of or relating to these Terms or the App shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration will be conducted in English, in the county where you reside or in San Francisco, California.

Exceptions: Either party may bring claims in small claims court if eligible. Either party may seek injunctive relief in court for intellectual property infringement.
YOU AND FLEEKSEEK AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION.
Unless both you and FleekSeek agree otherwise, the arbitrator may not consolidate more than one person's claims and may not preside over any form of class, collective, or representative proceeding. If this class action waiver is found to be unenforceable, then the entirety of this arbitration provision shall be null and void, and the dispute shall proceed in court.
We reserve the right to modify, suspend, or discontinue the App or any feature at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the App.
We may also modify subscription tiers, pricing, or usage limits. Changes to paid subscriptions will not affect your current billing period but may apply upon renewal.
This App is made available through the Apple App Store. You acknowledge that:
We may suspend or terminate your access to FleekSeek at any time if you violate these Terms. You may delete your account at any time from the Profile settings in the App.
We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the new Terms. We will update the "Last updated" date at the top of this page.
These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles. For any claims not subject to arbitration, you agree to submit to the exclusive jurisdiction of the state and federal courts located in San Francisco County, California.
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and FleekSeek regarding your use of the App. These Terms supersede any prior agreements, communications, or understandings, whether oral or written, regarding the subject matter herein.
Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by FleekSeek.
You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction, including in connection with a merger, acquisition, or sale of assets.
We shall not be liable for any failure or delay in performing our obligations due to causes beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, labor disputes, government actions, internet or telecommunications failures, or third-party service provider failures.
